1. Acceptance of Terms
By creating an account, placing an order, or otherwise accessing or using any service provided by Cybernet ("Cybernet", "we", "us", or "our"), you ("User", "you", or "Client") agree to be legally bound by these Terms of Service (the "Terms"), our Privacy Policy, and any service-specific policies referenced herein, including our Acceptable Use Policy. If you do not agree with any part of these Terms, you must not access or use our services.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.
2. Definitions
[ SERVICES ] means any product or service made available by Cybernet, including but not limited to shared web hosting, reseller hosting, VPS, dedicated servers, cloud infrastructure, domain name registration and renewal, SSL certificates, email hosting, and any associated support or add-on services.
[ CONTENT ] means any data, files, code, text, images, or other material uploaded, stored, transmitted, or made available by User through the Services.
[ CLIENT_AREA ] means the account management portal made available to Users to manage orders, invoices, tickets, and Services.
3. Eligibility & Account Registration
You must be at least 18 years of age, or the age of majority in your jurisdiction, to independently register for and purchase Services. A parent or legal guardian may open an account on behalf of a minor, and by doing so assumes full responsibility and liability for that minor's use of the Services.
You agree to provide accurate, current, and complete information during registration and to promptly update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. Notify our support team immediately of any suspected unauthorized use of your account.
4. Description of Services
Cybernet provides web hosting and related infrastructure services on a subscription basis, including shared hosting plans, virtual private servers, dedicated servers, domain registration and management, SSL/TLS certificates, and email hosting. Exact specifications, resource limits, and features for each plan are described on the relevant product or plan page at the time of order and form part of these Terms by reference.
We reserve the right to modify, upgrade, or discontinue any Service, or any feature of a Service, at any time. Where a change materially reduces the functionality of a Service you have already purchased, we will provide reasonable advance notice by email or through the Client Area.
5. Fees, Billing & Renewals
[ BILLING_CYCLE ] Services are billed in advance on a recurring basis (monthly, quarterly, semi-annually, annually, biennially, or triennially, as selected at checkout) unless otherwise stated. Domain registrations and renewals are billed annually or for the term selected at the time of order.
[ AUTO_RENEWAL ] Unless cancelled prior to the renewal date through the Client Area, Services renew automatically and the applicable fees are charged to the payment method on file. It is your responsibility to ensure your payment method remains valid and to cancel any Service you no longer wish to renew before the renewal date.
[ LATE_PAYMENT ] Invoices unpaid after their due date may result in suspension of the associated Service. Accounts remaining unpaid for an extended period, as communicated in payment reminder notices, may be terminated and associated Content permanently deleted. Prices are subject to change; where a renewal price differs from the initial order, we will provide notice before the change takes effect.
6. Refund & Cancellation Policy
[ MONEY_BACK ] New shared and reseller hosting plans purchased directly from Cybernet include a 30-day money-back guarantee. If you are not satisfied with the Service, you may request a full refund of the hosting fee within 30 days of the initial purchase by contacting support. This guarantee does not apply to domain registrations, SSL certificates, dedicated IP addresses, licenses (such as control panel or software licenses), setup fees, or any third-party product, all of which are non-refundable once provisioned due to their immediate and non-recoverable cost to Cybernet.
[ VPS_DEDICATED ] Virtual private server and dedicated server plans are provisioned on dedicated resources at the time of order and are non-refundable once the server has been deployed, except where required by applicable law.
[ CANCELLATION ] You may cancel any Service at any time from the Client Area. Cancellation stops future renewals; it does not entitle you to a prorated refund of the current billing period except as described above.
7. Acceptable Use Policy
You agree not to use the Services to store, transmit, or distribute any Content that: (a) is unlawful, fraudulent, defamatory, or infringes the intellectual property or privacy rights of any third party; (b) contains malware, ransomware, or other malicious code; (c) facilitates phishing, spamming, or unsolicited bulk email; (d) is used to launch or participate in denial-of-service attacks, port scanning, or other network abuse against third parties; or (e) depicts the sexual exploitation of minors, in any form, which will be reported to the appropriate authorities and result in immediate termination.
You are solely responsible for all Content hosted on your account and for ensuring your use of the Services complies with all applicable laws. We reserve the right, but not the obligation, to monitor Services for compliance with this Acceptable Use Policy and to remove Content or suspend Services that we reasonably believe violate it, with notice where practicable.
8. Service Availability & Support
Cybernet targets a monthly network and platform uptime of 99.9% for shared hosting, VPS, and dedicated server Services, excluding scheduled maintenance, for which we will provide advance notice through the Client Area or status page whenever feasible. Specific service-level commitments and any associated service credits, if offered for a given plan, are described on the relevant product page.
Technical support is provided through our ticketing system and knowledge base as described on our Support page. We do not guarantee specific response times except where explicitly stated in a paid support add-on.
9. Suspension & Termination
We may suspend or terminate any Service, with or without notice, if: (a) fees are past due; (b) your use of the Service violates these Terms, the Acceptable Use Policy, or applicable law; (c) your use of the Service poses a security risk to Cybernet or other clients; or (d) we are required to do so by a hosting or upstream provider, registrar, or law enforcement authority. Suspension does not relieve you of the obligation to pay outstanding fees.
You may terminate your account at any time through the Client Area. Upon termination, whether by you or by us, we may permanently delete all associated Content after a reasonable grace period as communicated at the time of suspension or termination.
10. Backups & Client Responsibility
While Cybernet may perform routine backups on certain plans as a courtesy, you remain solely responsible for maintaining independent backups of your Content. We strongly recommend maintaining your own off-platform backups at all times. Cybernet is not liable for any loss or corruption of Content, regardless of cause, including hardware failure, software error, or human error.
11. Intellectual Property
The Cybernet name, logo, website design, control panel interfaces, and all associated software, documentation, and materials are the property of Cybernet or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use Cybernet's trademarks or branding without our prior written consent.
You retain all rights to Content you upload to the Services. By using the Services, you grant Cybernet a limited license to host, store, and transmit that Content solely for the purpose of providing the Services to you.
12. Third-Party Services
Certain Services rely on or integrate with third-party providers, including domain registries and registrars, certificate authorities, payment processors, and upstream data-center or network providers. Your use of such third-party components may be subject to the applicable third party's own terms and policies, and Cybernet is not responsible for their acts, omissions, or availability.
13. Disclaimers & Limitation of Liability
The Services are provided on an "as is" and "as available" basis. Except as expressly stated in these Terms, Cybernet makes no warranties, express or implied, regarding the Services, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Cybernet's total liability arising out of or relating to these Terms or the Services shall not exceed the total fees paid by you for the affected Service in the three months preceding the event giving rise to the claim. Cybernet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages.
14. Indemnification
You agree to defend, indemnify, and hold harmless Cybernet, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services, your Content, or your violation of these Terms or applicable law.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be submitted to the exclusive jurisdiction of the courts located in Montreal, Quebec, and both parties consent to that venue and jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. Material changes will be announced through the Client Area or by email at least 15 days before taking effect. Continued use of the Services after the effective date of any revision constitutes your acceptance of the revised Terms. The current version is always available on this page, with its effective date noted at the top.
